Tenancy succession

Succession happens when someone eligible takes over a tenancy when the original tenant dies.

For most of our tenancies, there can only be one succession. So if the person who passed away succeeded to the tenancy themselves, there normally can't be another succession. 

Succession only happens automatically under certain conditions, including if:

  • you're a spouse, civil partner or certain relative (depending on the start date of the tenancy)
  • you lived with your relative for at least 1 year immediately before their death
  • there is a secure tenancy

The rules are different for flexible or introductory tenancies and we will discuss these with you.

You can only succeed a tenancy if we approve the claim.

If an inherited council house is too large for an individual's needs, or has major disabled adaptations, then we may provide suitable alternative accommodation.

Rent credit and arrears

If you succeed the tenancy, you are responsible for any credit or debit on the account.

You are also response for any neglect or abuse of the property.
