North Northamptonshire Council Road Traffic Regulation Act 1984

The North Northamptonshire Council (Brook Street, Raunds) (Prohibition of waiting) Order 20XX

North Northamptonshire Council ("the Council") in exercise of its powers under Sections 1, 2, 4 and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984 ("the 1984 Act") and all other enabling powers, and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 to the 1984 Act, hereby makes the following Order:

Citation and Commencement

1 This Order may be cited as the North Northamptonshire Council (Brook Street, Raunds) (Prohibition of Waiting) Order 2026 and shall come into operation on [Insert date].

Interpretation

2 In this Order:

"civil enforcement officer" means a person authorised by or on behalf of the Council to supervise and enforce the restrictions imposed by this Order.

"disabled person" and "disabled person's badge" have the same meanings as in the Disabled Persons (Badges for Motor Vehicles) (England) Regulations 2000.

"disabled person's vehicle" means a vehicle lawfully displaying a disabled person's badge.

"driver", in relation to a vehicle waiting on a road, means the person driving the vehicle at the time it was left on the road.

"motor vehicle" has the same meaning as in section 136 of the Road Traffic Regulation Act 1984.

"relevant position" means on the dashboard or fascia of the vehicle or where the vehicle is not fitted with a dashboard or fascia in a conspicuous position on the nearside of the vehicle, or if the vehicle is one being used by a disabled person has the same meaning as given in Regulation 4 of The Local Authorities' Traffic Orders (Exemptions for Disabled Persons) (England) Regulations 2000.

"road" means any length of highway or any other road to which the public has access.

"vehicle" means a motor vehicle, trailer or any other vehicle whether mechanically propelled or otherwise.

3 Any reference in this Order to an Article or Schedule shall be construed as a reference to the Article or Schedule bearing that number in this Order.

4 The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

Prohibition of Waiting

5 Save as provided in Articles 6 and 7, no person shall cause or permit any vehicle to wait at any time on that length of road specified in the Schedule to this Order.

Exemptions

6 Nothing in Article 5 shall render it unlawful to cause or permit a vehicle to wait for so long as may be reasonably necessary:

a. to enable a person to board or alight from the vehicle.
b. for the vehicle to be used in connection with any building operation, demolition, excavation or road works.
c. for the vehicle to be used in connection with the maintenance, improvement or reconstruction of a road.
d. for the vehicle to be used in connection with the laying, erection, alteration, repair or cleaning of any sewer, main, pipe, cable or apparatus for the supply of gas, water, electricity or telecommunications.
e. for the collection or delivery of goods or loading or unloading where such activity cannot reasonably be carried out otherwise than from that length of road.
f. in the service of a local authority, statutory undertaker, police, fire and rescue authority or ambulance service in pursuance of statutory powers or duties.

7 Nothing in Article 5 shall apply to:

a. a disabled person's vehicle displaying a valid disabled person's badge and parking disc in the relevant position for a period not exceeding three hours, provided that no such vehicle shall return to the same length of road within one hour of leaving that length of road.

b. a vehicle being used for police, fire and rescue or ambulance purposes where waiting is reasonably necessary in the circumstances.

Contraventions

8 If a vehicle is left in contravention of any provision of this Order, a penalty charge shall be payable and the vehicle may be subject to enforcement action pursuant to the Traffic Management Act 2004 and regulations made thereunder.

Revocation

9 Any provision of a Traffic Regulation Order previously made by the Council that is inconsistent with the restrictions imposed by this Order is hereby revoked, but only to the extent necessary to give effect to this Order and only insofar as it relates to the length of road specified in the Schedule.
