North Northamptonshire Council Road Traffic Regulation Act 1984

North Northamptonshire Council (A4500 Layby near Earls Barton) (Prohibition of vehicles) Order 20XX

North Northamptonshire Council in exercise of their powers under Sections 1, 2, 3 and 4 of the Road Traffic Regulation Act 1984 ("the Act of 84") and of all other enabling powers, and after consultation with the chief officer of police in accordance with Part III of Schedule 9 of the Act, hereby makes the following Order:

  1. This Order may be cited as “North Northamptonshire Council (A4500 layby near Earls Barton) (Prohibition of Vehicles) Order 20XX” and shall come into force on the XXXXXXX.
  2. In this Order:
    - “council” means, North Northamptonshire Council
    - "motor cycle" has the same meaning as in Section 185(1) of the Road Traffic Act 1988
    - “motor vehicle” has the same meaning as in Section 136(1) of the Act of 1984; and includes motor cycles
    - “pedal cycle’’ has the meaning as given in The Traffic Signs Regulations and General Directions 2016, Schedule 1, Regulation 2
    - “vehicle” has the same meaning as “motor vehicle”, “motor cycle” and pedal cycle as defined under this Article
  3. Save as provided in Article 4, No person shall, except with the permission of, or at the direction of a police officer in uniform, cause or permit any vehicle to enter or be in the layby section of the A4500 as indicated in the schedule to this Order at any time except for access.
  4. Nothing in Article 3 of this Order shall render it unlawful to cause or permit any vehicle to proceed along the length of road referred to in that article, if the vehicle is being used for any of the following purposes and the vehicle cannot conveniently be used for such purposes in any other road:
    - (a) police, fire, or ambulance purposes.
    - (b) in building, maintenance, industrial or demolition operations.
    - (c) the removal of any obstruction to traffic.
    - (d) the maintenance, improvement, or reconstruction of the said lengths of road.
    - (e) the laying, erection, alteration, removal, or repair in or on land adjacent to the said lengths of roads of any sewer or of any main, pipe or apparatus for the supply of gas, water, or electricity or of any communications equipment.
    - (f) in the service of a local authority or of a water company in pursuance of statutory powers or duties.
  5. The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation off an Act of Parliament.
  6. The restrictions imposed by this Order shall be in addition to and not in derogation from any restriction or requirement imposed by any other regulations made or having effect as if made under the Act of 1984 or by or under any other enactment.
