1. This notice

is issued by the council because it appears to it that there has been a breach of planning control, under Section 171A(1)(a) of the above Act, at the land described below. It considers that it is expedient to issue this notice, having regard to the provisions of the development plan and to other material planning considerations. The Annex at the end of the Notice contains important additional information.

2. Land to which this notice relates

The land (including any buildings thereon) known as Plot 20 Manor Meadows, Fotheringhay Road, Tansor, PE8 5HP

3. The matters which appear to constitute the breach of planning control

  1. Without planning permission, the material change in use of the land from a field in open countryside to an unauthorised use as a private leisure plot for mixed domestic garden, and open storage.

4. The reasons for issuing this notice

It appears to the Council that the above breach of planning control has occurred within the last 10 years.

The development is contrary to the following policies:

  1. Policy 3 of the North Northamptonshire Joint Core Strategy 2011 to 2031.

Policy 3 of the North Northamptonshire Joint Core Strategy: Landscape Character

Development should be located and designed in a way that is sensitive to its landscape setting, retaining and, where possible, enhancing the distinctive qualities of the landscape character area which It would affect.

Contrary to the Article 4 direction made on 11 April 2012, and confirmed on 31 August 2012 pursuant to the Town and Country (General Permitted Development) Order 1085 as amended.

5. What you are required to do

  1. Cease the use of the land as a private leisure plot for mixed domestic type garden and open storage purpose.
  2. Permanently remove from the land all storage type structures and associated paraphernalia and items, including any vehicles and trailers. 
  3. Permanently remove from the land any items of a domestic garden character, to include any PV panels
  4. Clear and permanently remove any other detritus on the land. 
  5. Cease, if any, permanent residential boat mooring use on the land.

4 Months from the date this notice takes effect

7. When this notice takes effect 

This notice takes effect on (specific date, not less than 28 clear days after date of Issue), unless an appeal is made against it beforehand.

Your right of appeal

You can appeal against this notice, but any appeal must be received, or posted in time to be received, by the Secretary of State before the date specified in paragraph 7 of the notice. You can appeal on-line or by post using forms available from The Planning inspectorate. Please read the guidance notes regarding making an appeal.

If you want your appeal to be considered under ground (a) you must pay a fee. The current fee is £924

What happens if you do not appeal

If you do not appeal against this enforcement notice, it will take effect on the date specified In paragraph 7 of the notice and you must then ensure that the required steps for complying with it, for which you are held responsible, are taken within the period(s) specified in paragraph 6 of the notice. Failure to comply with an enforcement notice which has taken effect can result in prosecution and/or remedial action by the Council.

Appeal costs

You should be aware that the Council has a policy of applying for an award of its costs against appellants whenever appropriate.
