Comments about prior notification applications

Certain types of applications are called 'prior notifications' and under the Town and Country Planning (General Permitted Development) (England) Order 2015 (and amendments), neighbours or experts can only comment on specific areas of the application.

These are confirmed below and any letters or notifications will confirm what type of comments can be considered.


Agricultural

Part 6 - Siting, design or appearance of the proposed development

Enlargement of a dwellinghouse by construction of additional storeys

Part 1 Class AA - Enlargement of a dwellinghouse by construction of additional storeys

  1. impact on the amenity of any adjoining premises including overlooking, privacy and the loss of light
  2. the external appearance of the dwellinghouse, including the design and architectural features of:
    • the principal elevation of the dwellinghouse
      and
    • any side elevation of the dwellinghouse that fronts a highway
  3. air traffic and defence asset impacts of the development
    and
  4. whether, as a result of the siting of the dwellinghouse, the development will impact on a protected view identified in the Directions Relating to Protected Vistas dated 15 March 2012 issued by the Secretary of State

Retail, betting office or pay day loan shop or casino to restaurant or cafe

Part 3 Class C – retail, betting office or pay day loan shop or casino to restaurant or cafe:

(a) noise impacts of the development
(b) odour impacts of the development
(c) impacts of storage and handling of waste in relation to the development
(d) impacts of the hours of opening of the development
(e) transport and highways impacts of the development
(f) whether it is undesirable for the building to change to a use falling within Class A3 (restaurants and cafes) of the Schedule to the Use Classes Order because of the impact of the change of use:

  • on adequate provision of services of the sort that may be provided by a building falling within Class A1 (shops) or, as the case may be, Class A2 (financial and professional services) of that Schedule, but only where there is a reasonable prospect of the building being used to provide such services
    or
  • where the building is located in a key shopping area, on the sustainability of that shopping area

and
(g) the siting, design or external appearance of the facilities to be provided under Class C (b)


Commercial, business and service or betting office or pay day loan shop to mixed use

Part 3 Class G - commercial, business and service or betting office or pay day loan shop to mixed use:

(a) contamination risks in relation to the building
(b) flooding risks in relation to the building
(c) impacts of noise from commercial premises on the intended occupiers of the development
(d) the provision of adequate natural light in all habitable rooms of the dwellinghouses
(e) arrangements required for the storage and management of domestic waste


Retail or betting office or pay day loan shop to assembly and leisure

Part 3 Class J – retail or betting office or pay day loan shop to assembly and leisure:

(a) noise impacts of the development
(b) impacts of the hours of opening of the development
(c) transport and highways impacts of the development; and
(d) whether it is undesirable for the building to change to a use falling within Class D2 (assembly and leisure) of the Schedule to the Use Classes Order because of the impact of the change of use:

  • on adequate provision of services of the sort that may be provided by a building falling within Class A1 (shops) or, as the case may be, Class A2 (financial and professional services) of that Schedule, but only where there is a reasonable prospect of the building being used to provide such services
    or
  • where the building is located in a key shopping area, on the sustainability of that shopping area

Part 3 Class M – certain uses to dwellinghouses:

(a) transport and highways impacts of the development
(b) contamination risks in relation to the building
(c) flooding risks in relation to the building
(d) whether it is undesirable for the building to change to a use falling within Class C3 (dwellinghouses) of the Schedule to the Use Classes Order because of the impact of the change of use:

  • on adequate provision of services of the sort that may be provided by a building falling within article 3(6)(c) (launderette) of the Use Classes Order, but only where there is a reasonable prospect of the building being used to provide such services

(e) the design or external appearance of the building
and
(f) the provision of adequate natural light in all habitable rooms of the dwellinghouses


Commercial, business and service uses to dwellinghouses

Part 3 Class MA - commercial, business and service uses to dwellinghouses:

(a) transport impacts of the development, particularly to ensure safe site access
(b) contamination risks in relation to the building
(c) flooding risks in relation to the building
(d) impacts of noise from commercial premises on the intended occupiers of the development
(e) where:

  • the building is located in a conservation area
    and
  • the development involves a change of use of the whole or part of the ground floor, the impact of that change of use on the character or sustainability of the conservation area

(f) the provision of adequate natural light in all habitable rooms of the dwellinghouses
(g) the impact on intended occupiers of the development of the introduction of residential use in an area the authority considers to be important for general or heavy industry, waste management, storage and distribution, or a mix of such uses
and
(h) where the development involves the loss of services provided by:

  • a registered nursery
    or
  • a health centre maintained under section 2 or 3 of the National Health Service Act 2006 the impact on the local provisions of the type of services lost.

(i) where the development meets the fire risk conditions, the fire safety impacts on the intended occupants of the building


Offices to dwellinghouses

Part 3 Class O – offices to dwellinghouses (developer must apply on or before 31 July 2021):

(a) transport and highways impacts of the development
(b) contamination risks on the site
(c) flooding risks on the site
(d) impacts of noise from commercial premises on the intended occupiers of the development
and
(e) the provision of adequate natural light in all habitable rooms of the dwellinghouses


Premises in light industrial use to dwellinghouses

Part 3 Class PA – premises in light industrial use to dwellinghouses:

(a) transport and highways impacts of the development
(b) contamination risks in relation to the building
(c) flooding risks in relation to the building
(d) whether the authority considers the building to which the development relates is within an area that is important for providing industrial services or storage or distribution services or a mix of those services (which includes, where the development relates to part of a building, services provided from any other part of the building), whether the introduction of, or an increase in, a residential use of premises in the area would have an adverse impact on the sustainability of the provision of those services
(e) the provision of adequate natural light in all habitable rooms of the dwellinghouses


Agricultural buildings to dwellinghouses 

Part 3 Class Q – agricultural buildings to dwellinghouses:

(a) transport and highways impacts of the development
(b) noise impacts of the development
(c) contamination risks on the site
(d) flooding risks on the site
(e) whether the location or siting of the building makes it otherwise impractical or undesirable for the building to change from agricultural use to a use falling within Class C3 (dwellinghouses) of the Schedule to the Use Classes Order
(f) the design or external appearance of the building
and
(g) the provision of adequate natural light in all habitable rooms of the dwellinghouses

Part 3 Class R – agricultural buildings to a flexible commercial use:
