1. This notice

is served by the Council, under Section 187A of the above Act, because they consider that conditions imposed on a grant of planning permission relating to the land described in paragraph 2 below, have not been complied with. The Council consider that you should be required to secure compliance with the conditions specified in this notice. The Annexe at the end of this notice contains important additional information.

2. Land to which this notice relates

The Land at The Barn, Denford House, Ringstead Road, Denford, Northamptonshire NN14 4EL, shown edged red on the plan.

3. The relevant planning permission

The relevant planning permission to which this notice relates is the permission granted by the Council on 21 May 2013 for Single storey extension to existing property to create a sunroom. Ref 13/00443/FUL

4. The breach of condition

The following conditions have not been complied with:

  1. Condition 3: The development hereby permitted shall be carried out strictly in accordance with the approved plan drg. N155-200 received by the Local Planning Authority on 19.03.2013. Reason: In order to clarify the terms of the planning permission and to ensure that the development is carried out as permitted.
  2. Condition 4: The roof area of the extension hereby permitted shall not be used as a balcony, roof garden or other similar amenity area. Reason: In the interest of residential amenity.

5. What you are required to do

As the person responsible for the breach of conditions specified in paragraph 4 of this notice, you are required to secure compliance with the stated conditions by taking the following steps:-

  1. Remove all residential paraphernalia from the roof area.
  2. Remove the balustrade from around the edge of the roof.
  3. Install black metal Juliet balcony guarding and railings to exterior of external doors to the master bedroom, as shown on approved drawing number N155-200 (see Appendix A).

6. Period for compliance

28 days beginning with the day on which this notice is served on you.

7. When this notice takes effect

This notice takes effect immediately it is served on you in person or on the day you received.

There is no right of appeal to the secretary of state for communities and local government against this notice.

It is an offence to contravene the requirements stated in paragraph 5 of this notice after the end of the compliance period. You will then be at risk of immediate prosecution in the Magistrates' Court, for which the maximum penalty is £2,500 for a first offence and for any subsequent offence.
