I would like to clarify that the statement which we released last week in relation to this matter still stands as our current position. The Council remain satisfied that Stanton Cross Developments LLP have the right to carry out the works under the statutory undertakers exemption provided by national legislation.

We note the requests that have been made for the Council to prevent these works from happening through the issue of a Temporary Stop Notice. I would therefore also wish to take this opportunity to state that, irrespective of the developers lawful right to carry out these works as set out above, a Temporary Stop Notice or Stop Notice under the Town & Country Planning Act 1990 cannot be used in relation to protected trees.

We will continue to liaise with Stanton Cross Developments LLP as the scheme develops.
